What can you learn from this DSI-2009-03 ruling by the DSI Disciplinary Committee?
A DSI-certified commercial director of an investment firm regularly appeared as a guest on a television program sponsored by his employer. In these broadcasts, he made specific investment recommendations on specific stocks, often of companies with small market capitalizations and limited transaction volume.
Investigations revealed that the certified and other employees were aware of the content of these recommendations prior to the broadcast. They executed transactions for clients as well as for themselves in the stocks in question even before the recommendations were made public.
The Disciplinary Committee ruled that this conduct violated the DSI Code of Conduct. The certified knowingly participated in transactions that undermined the principle of fair market conduct. He was suspended for three years and the ruling, including his name, was made public. The Appeals Committee upheld this decision.
